BIRMINGHAM, Ala. (April 4, 2022) – Mike Bell Accident & Injury Lawyers, LLC (MBAIL), a leading Alabama personal injury litigation firm, announced today that it has filed a lawsuit in Jefferson County Circuit Court on behalf of Teresa Foster (47) of Jacksonville, Florida against #1 Stunnas Motorsports Club Headquarters, Inc. of Chicago, Illinois. Attorneys Michael T. Bell; Donald E. Blankenship, Jr; and Kierra R. Irby serve as counsel for the Plaintiff.
On August 8, 2020, Plaintiff Foster travelled to Birmingham from Jacksonville to attend the anniversary celebration of the #1 Stunnas Motorsports Club, Inc. (Birmingham Chapter). The celebration included an alcohol-filled block party adjacent to the chapter’s clubhouse; located at 426 18th Street Ensley 35218. At approximately 11PM, an altercation ensued between several persons in attendance including an off-duty Birmingham Police officer. Several shots were fired into the retreating crowd, leaving one victim dead and several injured; including Plaintiff Foster who was rendered permanently paralyzed.
MBAIL named both the national organization, #1 Stunnas Motorsports Club Headquarters, Inc., and the Birmingham Chapter, #1 Stunnas Motorsports Club, Inc., as defendants in the lawsuit which alleges negligence, wanton and reckless conduct, violation of the Alabama Dram Shop Act, premise liability, and intentional infliction of emotional distress.
“At the time of the shooting, there was no security, no pat downs, and no metal detectors in use to detect the presence of weapons on those entering the party. To further add to the egregiousness of the incident, the entrance and exits to the party were blocked by pickup trucks which prevented the quick exit of over 100 people who were fleeing the hail of gunfire to find safety,” said Michael T. Bell, lead counsel to the Plaintiff. “People have a right to feel safe and be safe when they are invited to attend events like these. There is a duty to ensure that your patrons enter upon and leave your premises safely. Unfortunately, #1 Stunnas failed to keep it’s guests safe and now one family has lost a loved one and our client has to live the rest of her life in pain and unable to do the things that once brought her joy and happiness.”
